Rock Paper Scissors Official Rules TOURNAMENT

CONTEST PERIOD: The MrBeast Rock Paper Scissors Contest (the “Contest”) starts on September 16, 2022 at 12:00 a.m. Pacific Time (“PT”) and ends on October 14, 2022 at 11:59 p.m. PT (“Contest Period”). The Contest Period will be divided into twenty nine (29) daily entry periods (each, an “Entry Period”), with each Entry Period beginning at 12:00 a.m. PT and ending at 11:59 p.m. PT each calendar day throughout the Contest Period.

 

 

ELIGIBILITY: Contest is open to legal residents of the fifty (50) United States and the District of Columbia who are 13 years of age or older at the time of Contest registration. Eligible minors must obtain their parents or legal guardians permissions prior to participating. Employees, officers, and directors of Feastables, Inc. (“Sponsor”), Promo Watch, LLC, MrBeast YouTube LLC, Night Media, and their respective subsidiaries, affiliates, distributors, promotion and advertising agencies, and members of their immediate families (spouse and parents, children and siblings and each of their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. Void where prohibited by law. Contest is subject to all applicable federal, state and local laws. By participating, you agree to these Official Rules and to the decisions of the Sponsor, which are final and binding in all respects. Contest is void in Puerto Rico, U.S. territories and possessions and where prohibited by law.

 

HOW TO OBTAIN GAME PLAYS: During the Contest Period, there are three (3) ways to obtain game plays;

1. On-pack QR Code: Visit a participating retailer and use your mobile device to scan the QR code located on participating Feastables products and follow the instructions to log-in to your Feastables Rock Paper Scissors account or create an account free of charge to receive ten (10) game plays.

Alternatively, to receive ten (10) game plays without visiting a participating retailer or scanning a QR code, click here and follow the instructions to log-in to your Feastables Rock Paper Scissors account or create an account free of charge.

There will be a limit of ten (10) game plays via this method per person using only one (1) mobile phone number per Entry Period, regardless of how the entrant obtained the game plays via this method. Game plays received in excess of the Entry Period limit will be void.

2. Feastables Purchase: Visit www.feastables.com to make a purchase of any Feastables product(s). You will then receive an email shortly after purchase with a link which you must click to receive ten (10) game plays.

There will be a limit of ten (10) game plays via this method per person using only one (1) mobile phone number per Entry Period, regardless of how the entrant obtained the game plays via this method and regardless of how many Feastables products were purchased within each Entry Period. Game plays received in excess of the Entry Period limit will be void.

3. Rock Paper Scissors Account Creation: First-time visitors to feastables.com/rock-paper-scissors, who are yet to scan an eligible QR code or obtain game plays in any other method outlined herein for use in the Contest will receive ten (10) game plays after following the instructions at feastables.com/rock-paper-scissors to create their Feastables Rock Paper Scissors account.

There will be a limit of ten (10) game plays via this method per person and will only be available to those who have not previously received game plays and have not previously created a Feastables Rock Paper Scissors account. Game plays received in excess of the Entry Period limit will be void.

4. Sponsor Surprise and Delight: From time to time throughout the Contest Period, Sponsor may provide eligible entrants with free game plays via email, text message and social media. The exact date, time, and quantity of game plays made available through this surprise and delight method will vary and will be at the sole discretion of Sponsor.

 

CONTEST OBJECTIVE: The goal of the Contest is to achieve the highest successful Rock Paper Scissors “streak” throughout an Entry Period, which will then make you eligible to participate in the Finals Event (as described further below). 

 

HOW TO ENTER THE CONTEST: During each Entry Period, using the link received after scanning a feastable QR code, completing an eligible Feastables purchase, or obtaining ten (10) game plays without purchase via the link above, visit https://feastables.com/rock-paper-scissors  and log-in to your Feastables Rock Paper Scissors account. Then, follow the instructions to redeem a game play to participate in a virtual Rock Paper Scissors match against an opponent. Each virtual Rock Paper Scissors match will be a best of one (1) game. If you are successful (i.e., a winner) of your virtual Rock Paper Scissors match, your streak will begin (i.e., a winning streak of one (1) game) and you will proceed to your next virtual Rock Paper Scissors match for the opportunity to extend your streak to two (2) games, three (3) games, four (4) games and so forth if you are successful. Once you lose a match, your game play and corresponding streak (if applicable) will be over and you must redeem another game play to start over again to create and potentially achieve a higher streak. 

 

FINALIST DETERMINATION: Following the conclusion of each Entry Period, the one (1) entrant with the highest streak for each applicable Entry Period will be deemed a potential finalist, subject to verification of eligibility and compliance with these Official Rules. In the event of a highest streak tie between five (5) or fewer entrants for an Entry Period, all tied entrants will be deemed potential finalists and each receive the full $1,000 finalist prize outlined below and be eligible to participate in the Finalist Event (subject to verification of eligibility and compliance with these Official Rules). In the event of a highest streak tie between five (5) or more entrants for an Entry Period, all tied entrants will be deemed potential finalists and will evenly split a prize of $5,000 and be eligible to participate in the Finalist Event (subject to verification of eligibility and compliance with these Official Rules). Limit of one (1) finalist prize per person throughout the Contest Period.

 

FINALIST NOTIFICATION: Sponsor’s decisions are final and binding on all matters relating to this Contest, including but not limited to the tabulation of streaks. Potential finalists will be notified by telephone, mail and/or email within seven (7) days following the conclusion of the Contest Period. Potential finalists will be required to complete an Affidavit of Eligibility, Liability and Publicity Release (unless prohibited by law) and any other documents required by Sponsor which must be returned within three (3) days of date appearing on prize notification. Any potential winner of a prize or combination of prizes valued at $600 or more will also be sent, via email, an IRS W9 Form. Return of finalist notification as undeliverable, failure to sign and return requested documentation within 72 hours of date and time of receipt, the inability of Sponsor to contact a potential finalist within a reasonable time period or noncompliance with these Official Rules by any potential finalist will result in disqualification and, at Sponsor’s sole discretion, the applicable finalist opportunity may be awarded to a runner-up. If any potential finalist is an eligible minor in his/her jurisdiction of residence, Sponsor reserves the right to award the prize in the name of his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on the prize recipient set forth herein. 

 

FINALIST EVENT: Within one (1) year from the end of the Contest Period, Sponsor will virtually host a finalist event where all confirmed finalists will compete against each other to determine the one (1) grand prize winner who will receive the opportunity to play against MrBeast. Exact date and time of the finalist event will be determined by Sponsor, in their sole discretion. Confirmed finalists must be available to participate on date and time determined by Sponsor to be eligible to participate for the opportunity to receive the grand prize. 

Each confirmed finalist will be randomly assigned to compete against another confirmed finalist in a virtual Rock Paper Scissors match that may be live streamed by Sponsor. The winner of each match will move on to the next stage and be randomly assigned to compete in another match of virtual Rock Paper Scissors with a finalist who also won their latest finalist match. Once a finalist has lost a virtual Rock Paper Scissors match, their streak and participation in the finalist event will be complete. The finalist events will continue until there is one (1) finalist remaining, who will then be deemed the grand prize winner. Sponsor’s sole determination of Rock Paper Scissor match winners and losers will be final and binding.

 

GRAND PRIZE EVENT: Within one (1) year (twelve (12) months) from the end of the Contest Period, the one (1) grand prize winner will receive the opportunity to play an in-person Rock Paper Scissors match against MrBeast. If and only if the grand prize winner defeats MrBeast in the Rock Paper Scissors match, they will win the grand prize of $50,000. If the grand prize winner does not defeat MrBeast, they will not receive the grand prize of $50,000.

 

FINALIST PRIZES (29) (One (1) awarded per Entry Period): Each winner will receive $1,000 awarded to be awarded in a form as determined by the Sponsor in its sole discretion. Approximate Retail Value (“ARV”) $1,000 each. As noted above, in the event of a highest streak tie between five (5) or more entrants for an Entry Period, all tied entrants will be deemed potential finalists and will evenly split a prize of $5,000 and each will be eligible to participate in the Finalist Event (subject to verification of eligibility and compliance with these Official Rules).

 

GRAND PRIZE (1): Grand prize winner will receive a trip that includes one (1) night, two (2) days hotel accommodations for themselves and one (1) guest to a destination determined by the Sponsor in its sole discretion to play MrBeast in a Rock Paper Scissors match. The trip also includes roundtrip, coach class air transportation for winner and guest from a major U.S. gateway airport near winner’s residence to an airport near destination. Additionally, if and only if the grand prize winner defeats MrBeast in the Rock Paper Scissors match, they will receive $50,000 awarded in a form as determined by the Sponsor in its sole discretion. Approximate Retail Value ("ARV") of Trip is $2,000. Maximum ARV of grand prize: $52,000.

 

GRAND PRIZE/FINALIST EVENT FOOTAGE: Sponsor may record and/or take photos of finalists and/or grand prize winner during the finalist and grand prize events. Finalists and grand prize winner (and their respective parents or legal guardians, if applicable) on the premises may be photographed, videotaped and otherwise recorded by Sponsor (collectively, "Footage"). Footage will be owned by Sponsor who has the right to use, edit, adapt, post, stream, copy and exploit such Footage and all elements embodied therein, including any names and likenesses embodied therein, in any and all media now known or hereafter devised throughout the world, in perpetuity, for advertising, promotional, trade and other purposes. Finalists and grand prize winner understand and acknowledge that individuals present at the events may be included in the Footage, in Sponsor’s sole discretion and agree to help Sponsor retain necessary releases (as applicable) if requested by Sponsor to do so.

 

GRAND PRIZE CONDITIONS: Travel must be taken on dates designated by Sponsor. Final dates and location to be determined by the Sponsor in its sole discretion, and must be reserved based on Sponsor's sole discretion, or Sponsor will have no further obligation to such winner. Dates of departure and return are subject to change at the sole discretion of Sponsor. Any additional air or ground transportation necessary to redeem prize, or additional fees including service charges, meals, beverages, souvenirs, incidentals, gratuities, phone calls, travel insurance, and any and all other expenses not specifically mentioned herein are the sole responsibility of the winner. Winner and guest are responsible for and must already own all necessary travel authorizations such as passports, visas, and/or government identification. Winner and guests may also be required to quarantine, provide proof of vaccination, and/or provide proof of a negative COVID-19 test as instructed prior to travel within the timeframe specified by Sponsor or winner may forfeit the Grand Prize at Sponsor’s sole discretion. Other restrictions may apply. Sponsor will attempt to accommodate winner's preferred itinerary, but all specifics thereof will be at Sponsor's discretion. If the winner cannot comply with these restrictions or any other portion of these Official Rules, the prize will be forfeited in its entirety and an alternate winner may be chosen. If the winner resides within a 100-mile radius of destination, ground transportation will be provided in lieu of air transportation and no compensation or substitution will be provided in lieu thereof. Actual value may vary based on point of departure. In the event winner elects to travel with no guest , no compensation or substitution will be provided in lieu thereof. Flight details are subject to availability and airline carrier's regulations and conditions apply. The trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. Exact hotel to be determined by Sponsor, in its sole discretion. Grand Prize winner and his/her guest(s) irrevocably waives all claims against the Released Parties and agrees that the Released Parties will have no liability or responsibility for any claim arising in connection with participation in this Contest, the prizes awarded, personal injury, or wrongful death, a potentially heightened risk of exposure to communicable diseases, viruses, bacteria or illnesses (including, without limitation, COVID-19) and the causes thereof, and sickness arising as a result of the grand prize winner participating in the Contest and related activities, wherever, whenever or however the same may occur.  Grand prize winner fully understands that (a) the novel coronavirus SARS-CoV-2 and any resulting disease (together with any mutation, adaptation or variation thereof, “COVID-19”) is extremely contagious and there is an inherent risk of exposure to COVID-19 in any place where people are or have been present; (b) no precautions, including the protocols that will be implemented from time to time by any/all travel providers or those providing accommodations, can eliminate the risk of exposure to COVID-19; (c) while people of all ages and health conditions have been adversely affected by COVID-19, certain people have been identified by public health authorities as having greater risk based on age and/or underlying medical conditions; and (d) exposure to COVID-19 can result in being subject to quarantine requirements, illness, disability, other short-term and long-term health effects, and/or death, regardless of age or health condition. 

 

GENERAL PRIZE CONDITIONS: All federal, state and local taxes and all other costs associated with prize acceptance and use not specified herein as being provided are the sole responsibility of each winner. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Winners may not substitute, assign or transfer prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute a prize (or portion thereof) with one of comparable or greater value. All prize details are at Sponsor’s sole discretion. 

 

GENERAL CONDITIONS:  By participating, each entrant agrees: (a) to abide by these Official Rules and decisions of Sponsor, which shall be final and binding in all respects relating to this Contest; (b) to release, discharge and hold harmless Sponsor, Promo Watch, LLC, MrBeast YouTube LLC, Night Media their respective subsidiaries, affiliates, distributors, promotion and advertising agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the foregoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Contest or any Contest-related activity or the acceptance, possession, use or misuse of any prize; and (c) to the use of his/her name, voice, entry, and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor, its affiliates and agencies, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use. 

 

MISCELLANEOUS: Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled entries, or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of entries, Rock Paper Scissors matches, the announcement of the prizes, or in any Contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to any person's computer related to or resulting from participating in this Contest or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Contest or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Should any portion of the Contest be, in Sponsor’s sole opinion, compromised for any reason, including virus, worms, bugs, epidemic, pandemic, any Act of God, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest (or portion thereof) and, if terminated, at its discretion, select the potential winners from among all non-suspect, eligible Entries received prior to action taken using the winner determination process outlined above. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK ANY AND ALL AVAILABLE REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

 

ARBITRATION: Except where prohibited by law, as a condition of participating in this Contest, entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this Contest, or prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than entrant's actual out-of-pocket expenses (i.e., costs associated with participating in this Contest), and entrant further waives all rights to have damages multiplied or increased.

 

CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the State of Illinois, USA.
