SWEEPSTAKES DESCRIPTION:  The Feastables Blue Wave $10k Daily Sweepstakes (the “Sweepstakes”) begins on February 17, 2024 at 12:00 a.m. Eastern Time (“ET”) and ends on March 17, 2024 at 11:59 p.m. ET (the “Sweepstakes Period”).

 

The Sweepstakes Period will be broken into individual daily entry periods (each, a “Daily Entry Period”) according to the following schedule:

Additionally, at the end of the Sweepstakes Period, one (1) Sweepstakes Period Prize winner will be selected from among all eligible entries received throughout the Sweepstakes Period, as described herein.

 

Entry in the Sweepstakes does not constitute entry into any other promotion, contest or sweepstakes.  By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Feastables, Inc., 1189 Wilmette Ave., #225, Wilmette, IL  60091 (“Sponsor”), which shall be final and binding in all respects.

 

ELIGIBILITY:  Only legal United States residents residing in the fifty (50) United States and the District of Columbia, which, for clarification, specifically excludes Puerto Rico and U.S. territories and possessions, who are sixteen (16) years of age or older are eligible to enter.  Eligible entrants who are less than the age of majority in their state or jurisdiction of primary residence (a ‘minor’) must have a parent/legal guardian’s permission to participate in the Sweepstakes.  Employees, officers and directors of Sponsor, MrBeast, participating retailers and their respective parent companies, affiliates, subsidiaries, advertising, fulfillment and marketing agencies, and influencers (collectively, the “Sweepstakes Entities”) and the immediate family members, and/or those living in the same household of each, are ineligible to enter the Sweepstakes or win a prize.  Sweepstakes is void in Puerto Rico, U.S. territories and possessions and where prohibited by law.

 

HOW TO ENTER:

 

1. Feastables Purchase at Retail.  During the Sweepstakes Period, visit a participating retailer and purchase Feastables product(s). Then, using your mobile phone, take a photo of your store receipt that clearly includes the date, store name/location and eligible Feastables product(s) purchased. Scan the QR code on the Feastables product or visit feastables.com/pages/blue-wave-sweepstakes and follow the on-screen instructions to complete the Sweepstakes online entry form, upload your store receipt and submit to receive one (1) entry into the Daily Entry Period drawing corresponding to the of your purchase for each individual product purchased (up to the maximum of ten (10) entries per day). 
2. NO PURCHASE NECESSARY – MAIL IN.  To enter the Sweepstakes without making a purchase, handprint your complete name, address, city, state, ZIP code, e-mail address, and daytime phone number (including area code) on a 3”x5” card, and mail in a business-size #10 envelope with the date corresponding to the Daily Entry Period drawing in which you want your entry deposited into clearly indicated on the front of the envelope and proper postage affixed to: Feastables Blue Wave $10k Daily Sweepstakes Entry, Dept #861328, PO Box 5265, Kalamazoo, MI  49003-5265. Entrants will receive the maximum of ten (10) entries into the corresponding drawing for each Mail-In entry received. All Mail-In entries must be postmarked by and received by the corresponding dates in the chart above to be considered for entry.  Each request must be mailed separately.  No typed, computer printed, mechanically reproduced, photocopied, illegible, or incomplete entries will be accepted, and all such entries will be void. 
3. Bonus Entries.  You may receive one (1) additional entry for signing up to receive email marketing messages from Sponsor and one (1) additional entry for signing up to receive SMS text message marketing messages from Sponsor.  Your entry will be deposited into the Entry Period drawing corresponding to the date that you subscribe.  You do not need to remain subscribed to receive marketing emails or SMS text messages in order to remain eligible for the corresponding Entry Period drawing and may opt out of either at any time by following the instructions in any email or SMS text message received.

 

 

Limit of ten (10) entries per person, per day, regardless of method of entry plus two (2) bonus entries for the duration of the Sweepstakes Period.  All entries received from any person that exceed the stated limitation will be disqualified.  For purposes of these Official Rules, a ‘day’ is defined as any twenty-four (24) hour period during the Sweepstakes Period beginning at 12:00 a.m. ET and ending twenty-four (24) hours later at 11:59 p.m. ET.

 

All entries must be received in accordance with the deadlines stated herein in order to participate.  The Website’s database clock will be the official timekeeper for online entries in this Sweepstakes.  In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible.  The Sweepstakes Entities shall not be responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of the entries in the Sweepstakes.  The Sweepstakes Entities assume no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of entries.  

 

WINNER SELECTION AND NOTIFICATION:  On or about March 29, 2024, prize winners for each Daily Entry Period will be randomly selected from all eligible entries received for the corresponding Daily Entry Period and one (1) Sweepstakes Period Prize winner will be randomly selected from all eligible entries received throughout the Sweepstakes Period.  The potential prize winners will be notified by phone and/or e-mail, using contact information provided or collected at the time of entry. Potential winners will be required to execute, have notarized and return an affidavit or declaration of eligibility, a liability release, an IRS W-9 Form (if an eligible resident of the United States) and, where lawful, a publicity release within seventy two (72) hours from time of initial notification from Sponsor (or shorter time if required by exigencies). In the event the winner is less than the age of majority in their state of primary residence, such winner’s parent/legal guardian must also sign any required prize claim documents on behalf of the winner.  If such documents are not returned within the specified time-period, prize notification is returned as undeliverable, Sponsor is unable to contact a potential winner or a potential winner is not in compliance with these Official Rules, such prize will be forfeited and, at Sponsor’s discretion, an alternate winner may be selected for the applicable prize. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by the potential winner for any reason. Sponsor, in its sole discretion, will attempt to contact up to three (3) potential winners of each prize in accordance with the above procedure, after which the prize in question may go unawarded if it remains unclaimed. If a potential prize winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines the prize for any reason prior to award, such potential prize winner will be disqualified and an alternate prize winner may be selected. If a potential winner is an eligible minor in their jurisdiction of residence, Sponsor reserves the right to award the prize in the name of their parent or legal guardian who will be responsible for fulfilling all requirements imposed on winner set forth herein. The odds of winning a Daily Prize depend on the number of eligible entries received per Daily Entry Period for the corresponding Daily Entry Period.  The odds of winning the Sweepstakes Period Prize depend on the total number of eligible entries received throughout the Sweepstakes Period.

 

 

PRIZES:  

Thirty (30) Daily Prizes are available.  Each Daily Prize consists of $10,000.

One (1) Sweepstakes Period Prize is available.  The Sweepstakes Period Prize consists of a year’s supply of Feastables chocolate (awarded as 365 bars/37 boxes).  The approximate retail value of the Sweepstakes Period Prize is $1,110.

All federal, state and local taxes and all other costs associated with prize acceptance and use not specified herein as being provided are the sole responsibility of each winner. Winners of prizes will receive an IRS Form 1099 for the actual retail value of the prize received.  Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Winners may not substitute, assign or transfer prize. 

GENERAL:  Acceptance of a prize constitutes prize winner’s (and, in the case of an eligible minor winner, such minor winner’s parent/legal guardian on their behalf) permission for Sponsor and its designees to use prize winner’s name, photograph, likeness, voice, biographical information, statements and address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation.  Entrants (and, in the case of an eligible minor entrant, such minor entrant’s parent/legal guardian on their behalf) agree that the Sweepstakes Entities to the extent permissible by law (A) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Sweepstakes or any Sweepstakes-related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of any prize, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose.  However, nothing in these Official Rules shall limit or exclude the Sweepstakes Entities' liability for death or personal injury causes by its negligence or for any other matter where liability may not, as a matter of law, be limited or excluded. 

 

Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, or stolen entries or prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information.  Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.  No mechanically reproduced, illegible, incomplete, forged, software-generated or other automated multiple entries will be accepted.  Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein. In the event Sponsor is prevented from awarding a prize or continuing with the Sweepstakes as contemplated herein by any event beyond its control, Sponsor shall have the right to modify, suspend, or terminate the Sweepstakes.  If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select winners in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination.  Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances.  These Official Rules cannot be modified or amended in any way except in a written document issued by a duly authorized representative of Sponsor.  The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

 

GOVERNING LAW:  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants or Sponsor in connection with the Sweepstakes shall be governed by and construed in accordance with the internal laws of the State of Illinois, USA without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws.
