Feastables Halloween $10,000 Daily Sweepstakes Rules

SWEEPSTAKES DESCRIPTION:  The Feastables Halloween $10,000 Daily Sweepstakes (the “Sweepstakes”) begins on begins on September 23, 2024 for mail-in participation and otherwise begins October 1, 2024 at 12:00 a.m. Pacific Time (“PT”) for purchase participation, and ends on October 30, 2024 at 11:59 p.m. PT (the “Sweepstakes Period”).

The Sweepstakes Period will be broken into thirty (30) individual daily entry periods (each, a “Daily Entry Period”).  Mail-in entries must be postmarked no earlier than September 22, 2024.  Entries must be received according to the following schedule:

Additionally, after the end of the Sweepstakes Period, one (1) Sweepstakes Period Prize winner will be selected from among all eligible entries received throughout the Sweepstakes Period, as described herein.

Entry in the Sweepstakes does not constitute entry into any other promotion, contest or sweepstakes.  By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with, be legally bound by, and abide to by these Official Rules and the decisions of Feastables, Inc., 167 N Green Street, Chicago, IL  60607 (“Sponsor”), which shall be final and binding in all respects.

ELIGIBILITY:  Only legal United States residents residing in one (1) of the fifty (50) United States or the District of Columbia at the time of entry, and legal residents of Canada, who are thirteen (13) years of age or older, are eligible to enter.  Eligible entrants who are less than the age of majority (19 in the states of AL and NE and in the following provinces/territories British Columbia, New Brunswick, Newfoundland, Northwest Territories, Nova Scotia, Nunavut, and Yukon, and 21 in MS and 18 in all other states/provinces/territories) in their state or province of primary residence (a ‘minor’) must have a parent/legal guardian’s permission to participate in the Sweepstakes (and, by entering each minor confirms that such parent/legal guardian has agreed, on the minor’s behalf and on their own behalf, to be legally bound by these Official Rules).  Employees, officers and directors of Sponsor, MrBeast Youtube LLC, Zaxby’s Franchising LLC, participating retailers, and distributors and their respective parent companies, affiliates, subsidiaries, advertising, fulfillment and marketing agencies (collectively, the “Sweepstakes Entities”) and the immediate family members, and/or those living in the same household of each, are ineligible to enter the Sweepstakes or win a prize.  Sweepstakes is void where prohibited by law.

Note to minors: The Sponsor reserves the right, in its sole and absolute discretion, on a random audit basis or at any time and for any reason, to contact a minor’s parent/legal guardian for the purposes of verifying their agreement to be legally bound by these Official Rules and consent to the minor’s participation in this Sweepstakes (failure of a minor’s parent/legal guardian to complete any such required verification to the complete satisfaction of the Sponsor may, at Sponsor’s discretion, result in the disqualification of such minor).

HOW TO ENTER:

NO PURCHASE NECESSARY.

There are two (2) ways to enter the Sweepstakes:

1. Feastables Purchase at Retail.  Visit a participating in-store or online retailer (online includes purchases made on Feastables.com and Amazon.com in the U.S. only and all other online retailers and ) and purchase Feastables product(s) or purchase a MrBeast box at a participating Zaxby’s in the U.S. Then, during the Sweepstakes Period using your mobile phone, take a photo of your receipt that clearly includes the purchase date, store name/location and eligible Feastables product(s) purchased. Scan the QR code on the Feastables product or visit feastables.com/pages/pages/halloween-sweepstakes and follow the on-screen instructions to complete the Sweepstakes online entry form, upload your store receipt photo and submit during the Sweepstakes Period to receive one (1) entry into the Daily Entry Period drawing corresponding to the date of entry. Receipts must be dated between September 1, 2024 and October 30, 2024.  You do not need to enter your receipts on the date of purchase as long as they are entered during the Sweepstakes Period.  You will receive one (1) entry for each individual eligible product purchased and submitted (up to a maximum of twenty-four (24) entries per day), regardless of whether such products were purchased individually or as part of a single transaction (for example, if you purchased two (2) Feastables products in a single transaction and on the same day purchased one (1) Feastables product in a separate transaction, you may submit both purchase receipts to be eligible to receive three (3) entries into the applicable Daily Entry Period drawing). IMPORTANT NOTE: to be eligible for an entry, receipt photos must be uploaded and submitted as set out above on the website during the Sweepstakes Period.  
   
   
2. NO PURCHASE NECESSARY – MAIL IN.  To enter without making a purchase (the “AMOE”), click here:  https://easyscanamoe.com/easyscan/default/enter?amoe_key=n2esqbdwd6  (the “AMOE Website”) and complete the Entry Request (“Request”) form in its entirety with your complete name, address, city, state/province, ZIP/postal code, country, e-mail address, daytime phone number (including area code), and age and select the Daily Entry Period in which you want to enter via the dropdown menu available.  Once the Request form is completed, follow the instructions to print out the form and affix the barcode to a post card with first class postage affixed and mail it to the address provided on the AMOE Website. All Requests must be mailed as set forth herein and received by the Mail-In Receive By Date corresponding to the Daily Entry Period for your Request. Limit one (1) barcode per Request. Limit one (1) Request per person per Daily Entry Period. Requests in excess of this limit will be disqualified. Entrants will receive the maximum of twenty-four (24) entries into the corresponding Daily Entry Period drawing and twenty-four (24) entries into the Sweepstakes Entry Period drawing for each Request received. Each request must be mailed separately.  No copies, facsimiles or mechanical reproductions will be accepted. Sponsor assumes no responsibility for lost, late, incomplete, stolen, misdirected, illegible or postage due entries or mail.

Limit of twenty-four (24) entries per person, per day of the Sweepstakes Period, regardless of method of entry.  All entries received from any person that exceed the stated limitation will be disqualified.  For purposes of these Official Rules, a ‘day’ is defined as any twenty-four (24) hour period during the Sweepstakes Period beginning at 12:00 a.m. PT and ending twenty-four (24) hours later at 11:59 p.m. PT.

IMPORTANT NOTE: For entries obtained pursuant to option 1 above, please retain your original Feastables product receipt(s), as such receipt(s) may be required to be presented to the Sponsor, at its sole discretion, as part of the verification procedure outlined below.

All entries must be received in accordance with the deadlines stated herein in order to participate.  The Website’s database clock will be the official timekeeper for online entries in this Sweepstakes.  In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible.  The Sweepstakes Entities shall not be responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of the entries in the Sweepstakes.  The Sweepstakes Entities and each of their respective agents, representatives, employees, directors, officers, successors, and assigns (collectively, the “Released Parties”) assume no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of entries.  

WINNER SELECTION AND NOTIFICATION:  On or about each of the drawing dates in the chart above, one (1) Daily Prize winner for the corresponding Daily Entry Period will be randomly selected from all eligible entries received for the corresponding Daily Entry Period. After the end of the Sweepstakes Period on October 31, 2024, one (1) potential Sweepstakes Period Prize winner will be randomly selected from all eligible entries received throughout the Sweepstakes Period.  The potential prize winners will be notified by phone and/or e-mail, using contact information provided or collected at the time of entry. Potential winners (if an eligible resident of the United States) will be required to execute, have notarized and return an affidavit or declaration of eligibility, a liability release, an IRS W-9 Form and, where lawful, a publicity release, or (if an eligible resident of Canada) execute and return the Sponsor’s declaration and release form (which, among other things, acknowledges acceptance of the Prize as awarded, releases the Released Parties from any and all liability in connection with this Sweepstakes, and includes a publicity release), within seventy-two (72) hours from time of initial notification from Sponsor (or shorter time if required by exigencies and as communicated by the Sponsor). Additionally, as a condition of being declared an official winner and receiving any prize, Canadian residents must first correctly answer without assistance of any kind, whether mechanical or otherwise, a mathematical skill testing question via email or other means as determined by Sponsor in their sole discretion.  In the event the winner is a minor, such winner’s parent/legal guardian must also sign any required prize claim documents on behalf of the winner.  If such documents are not returned within the specified time-period, prize notification is returned as undeliverable, Sponsor is unable to contact a potential winner, a potential winner (if a resident of Canada) fails to correctly answer the skill testing question within the specified time, or a potential winner is not in compliance with these Official Rules, such prize will be forfeited and, at Sponsor’s discretion, an alternate winner may be selected for the applicable prize. Sponsor and all other Released Parties shall have no liability for any winner notification that is lost, intercepted or not received by the potential winner for any reason. Sponsor, in its sole discretion, will attempt to contact up to three (3) potential winners of each prize in accordance with the above procedure, after which the prize in question may go unawarded if it remains unclaimed. If a potential prize winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines the prize for any reason prior to award, such potential prize winner will be disqualified and an alternate prize winner may be selected. If a potential winner is an eligible minor in their jurisdiction of residence, Sponsor reserves the right to award the prize in the name of their parent or legal guardian who will be responsible for fulfilling all requirements imposed on winner set forth herein. The odds of winning a Daily Prize depend on the number of eligible entries received per Daily Entry Period for the corresponding Daily Entry Period.  The odds of winning the Sweepstakes Period Prize depend on the total number of eligible entries received throughout the Sweepstakes Period.

PRIZES:  

Thirty (30) “Daily Prizes” are available at the start of the Sweepstakes Period (number available will decrease throughout Sweepstakes Period as such prizes are claimed in accordance with these Official Rules).  Each Daily Prize consists of $10,000 USD.

One (1) “Sweepstakes Period Prize” is available.  The Sweepstakes Period Prize consists of a year’s supply of Feastables chocolate (awarded as 365 bars/37 boxes).  The approximate retail value of the Sweepstakes Period Prize is $1,110 USD (approximately $1,508.49 CAD).

All federal, state, provincial and local taxes and all other costs associated with prize acceptance and use not specified herein as being provided are the sole responsibility of each winner, as applicable. Winners of prizes (if a United States resident) will receive an IRS Form 1099 for the actual retail value of the prize received.  Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Winners may not substitute, assign or transfer prize. Released Parties accept no obligation or liability whatsoever in respect of any decision regarding the subsequent distribution, allocation, use or misuse of any prize.

GENERAL:  Acceptance of a prize constitutes prize winner’s (and, in the case of an eligible minor winner, such minor winner’s parent/legal guardian on their behalf) permission for Sponsor and its designees to use prize winner’s name, photograph, voice, biographical information, statements and address (city and state/province/territory) and any other likeness for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further notice or compensation.  Entrants (and, in the case of an eligible minor entrant, such minor entrant’s parent/legal guardian on their behalf) agree that the Sweepstakes Entities and all other Released Parties to the extent permissible by law (A) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Sweepstakes or any Sweepstakes-related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of any prize, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose.  However, nothing in these Official Rules shall limit or exclude the Released Parties’ liability for death or personal injury causes by its negligence or for any other matter where liability may not, as a matter of law, be limited or excluded. 

Released Parties are not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, or stolen entries or prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information.  Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.  No mechanically reproduced, illegible, incomplete, forged, software-generated or other automated multiple entries will be accepted.  Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein. In the event Sponsor is prevented from awarding a prize or continuing with the Sweepstakes as contemplated herein by any event beyond its control, Sponsor shall have the right to modify, suspend, or terminate the Sweepstakes.  If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select winners in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination.  Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances.  These Official Rules cannot be modified or amended in any way except in a written document issued by a duly authorized representative of Sponsor.  The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

All entries, receipts, mail-in entries, entrants and Sweepstakes-related information submitted are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of purchase, identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an entrant’s eligibility to participate in this Sweepstakes; (ii) for the purposes of verifying the eligibility and/or legitimacy of any entry, receipt photo, mail-in entry and/or other information entered (or purportedly entered) for the purposes of this Sweepstakes; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Sweepstakes in accordance with the letter and spirit of these Official Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor.

By entering this Sweepstakes, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted only for the purpose of administering the Sweepstakes and in accordance with the Sponsor’s privacy policy (available at: https://feastables.com/policies/privacy-policy). This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.

 

GOVERNING LAW:  To the fullest extent permitted by law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants or Sponsor in connection with the Sweepstakes shall be governed by and construed in accordance with the internal laws of the State of Illinois, USA without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws.

BY ENTERING THE SWEEPSTAKES, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (C) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (D) ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.
