Feastables Halloween $1 Million Sweepstakes

OFFICIAL RULES

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN.  A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING.

 

SWEEPSTAKES DESCRIPTION:   The Feastables Halloween $1 Million Sweepstakes (the “ Sweepstakes ”) takes place from 12:00 a.m. Pacific Time (“ PT ”) to 9:59 p.m. PT o n October 31, 2024  (the “ Sweepstakes Period ”).  Entry in the Sweepstakes does not constitute entry into any other promotion, contest or sweepstakes.  By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with, be legally bound by, and to abide by these Official Rules and the decisions of Feastables, Inc., 167 N. Green Street, Floor 4, Chicago, IL  60607 (“ Sponsor ”), which shall be final and binding in all respects.

 

ELIGIBILITY:   Only legal United States residents residing in one of the fifty (50) United States and the District of Columbia at the time of entry, and legal residents of Canada, who are thirteen (13) years of age or older, are eligible to enter.  Eligible entrants who are less than the age of majority (19 in the states of AL and NE and in the following provinces/territories British Columbia, New Brunswick, Newfoundland, Northwest Territories, Nova Scotia, Nunavut, and Yukon, and 21 in MS and 18 in all other states/provinces/territories) in their state or province of primary residence (a ‘minor’) must have a parent/legal guardian’s permission to participate in the Sweepstakes (and, by entering each minor confirms that such parent/legal guardian has agreed, on the minor’s behalf and on their own behalf, to be legally bound by these Official Rules and to sign and return all necessary documentation in the event of being selected as a p otential winner ).  Employees, officers and directors of Sponsor, MrBeast Youtube LLC, participating retailers and their respective parent companies, affiliates, subsidiaries, advertising, fulfillment and marketing agencies (collectively, the “ Sweepstakes Entities ”) and the immediate family members, and/or those living in the same household of each, are ineligible to enter the Sweepstakes or win a prize.  Sweepstakes is void where prohibited by law.

 

Note to minors: The Sponsor reserves the right, in its sole and absolute discretion, on a random audit basis or at any time and for any reason, to contact a minor’s parent/legal guardian for the purposes of verifying their agreement to be legally bound by these Official Rules and consent to the minor’s participation in this Sweepstakes (failure of a minor’s parent/legal guardian to complete any such required verification to the complete satisfaction of the Sponsor may, at Sponsor’s discretion, result in the disqualification of such minor).

 

HOW TO ENTER:

NO PURCHASE NECESSARY.

 

During the Sweepstakes Period, showing take a photo of yourself holding a Feastables bar showing “How you Halloween” OR to enter without a Feastables bar, take a photo of yourself with a sign that says “I Love Feastables #FeastablesHalloweenSweepstakes” and post your photo (collect ively “ Photo ”) to your public Instagram or X account and tag @Feastables (the “ Tag ”) and include, clearly and prominently, the hashtag #FeastablesHalloweenSweepstakes  in the text copy of the post (the “ Required Hashtag ”).  You must include both the Tag and Required Hashtag for your post to be eligible as an entry into the Sweepstakes.   Photos will not be judged.

 

To enter via Instagram or X, you'll first need to become a registered user of www.Instagram.com  (“ Instagram ”) or www.X.com   and  log into your Instagram or X account.  If you do not have an account, go to www.Instagram.com  or www.X.com  to create one. Instagram and X accounts are free. By submitting your information and creating an Instagram and/or X account, you agree to the Instagram and/or X Terms of Use and Privacy Notice. If you do not agree to such Terms of Use and Privacy Notice, you cannot create an Instagram or X account, or participate in this Sweepstakes via Instagram and/or X.  Additionally, your Instagram account must be set to public and allow your account to receive direct messages from the Sponsor. The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Instagram or X. Instagram and X are  hereby completely released of all liability by each entrant in this Sweepstakes. Any questions, comments or complaints regarding the Sweepstakes must be directed to the Sponsor and not to Instagram or X. To be eligible, all Instagram and X entries must be in accordance with these Official Rules and Instagram’s or X ’s (as applicable) terms, rules, policies and guidelines, in Sponsor ’s discretion .

 

Limit of one (1) entry per person per social media platform (for a total of two (2) total entries) for the duration of the Sweepstakes Period.   All entries received that exceed the stated limitation will be disqualified.  

 

Each Photo must meet the following “ Photo Requirements ” (any Photo that, in Sponsor’s sole and absolute discretion, violates the following criteria will be disqualified):

  • Photo must be responsive to the call-to-action (show us “How You Halloween” ), featuring the entrant only , holding either a Feastables bar or a sign that says “I Love Feastables #Feastables HalloweenSweepstakes ” and the post must include the Required Hashtag ;
  • Photo (including, without limitation, the sign that says “I Love Feastables # FeastablesHalloweenSweepstakes ” and all other content or materials submitted in or with the Photo, including the text of the post copy ) must reflect entrant’s true and honest opinion of and experience with the Sponsor;
  • Entrant must be the rightful owner of the Photo;
  • Photo must include only the entrant , and  may not feature any third party’s name, image, or likeness;  
  • Photo must NOT contain subject matter which is, or could be considered, in the sole discretion of the Sweepstakes Entities, obscene, pornographic, violent (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), defamatory, libelous, discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g., illegal gambling, underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane, hateful, degrading, harassing, or otherwise unlawful, tortious or objectionable;
  • Photo must NOT contain any content that promotes any particular political agenda or message;
  • Photo must NOT contain any personal identification, such as personal names or e-mail addresses;
  • Photo must NOT communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate;
  • Photo must NOT violate any law, regulation or guideline;
  • Photo must be compliant with Sponsor’s Terms of Service available at https://feastables.com/policies/terms-of-service  and the Instagram.com and X.com Terms as applicable ; and
  • Photo must NOT contain any derogatory references to any of the Sweepstakes Entities.

 

Note:  Sponsor reserves the right, in its sole discretion, to disqualify any entry in the Sweepstakes if Sponsor views the Photo if it deems the Photo to be lacking in taste, quality, or to be objectionable or otherwise not in compliance with the Photo Requirements. Sponsor reserves the right to waive the Photo Requirements in its reasonable discretion.  

 

Should any Instagram or X entry be taken down as the result of a takedown notice prior to being counted as an entry into the Sweepstakes, such entry will not be counted as an entry into the Sweepstakes.

 

By participating in the Sweepstakes, each entrant hereby warrants and represents that their entry, including without limitation the Photo submitted, complies with the Photo Requirements and all other requirements set out within these Official Rules.

 

All entries must be received in accordance with these Official Rules, including without limitation the deadlines stated herein, in order to participate.  Sponsor ’s database clock will be the official timekeeper for online entries in this Sweepstakes.  In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible.  The Sweepstakes Entities shall not be responsible for incorrect or inaccurate entry information whether caused by Internet users, the  social media platforms,  or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of the entries in the Sweepstakes.  The Sweepstakes Entities, Meta, Inc., and each of their respective agents, representatives, employees, directors, officers, successors, and assigns (collectively, the “ Released Parties ”) assume no responsibility or liability for any error, omission, interruption, delay, deletion, theft or destruction, or unauthorized access to, or alteration of entries.  

 

GRANT OF RIGHTS: Each entrant into the Sweepstakes hereby irrevocably grants to Sponsor, its designees, affiliates, successors and assigns, the non-exclusive, irrevocable, fully paid, universal license to use, copy, sublicense, transmit, distribute, publicly perform, publish, delete, display or otherwise exploit the Photo in any media now known or hereafter devised including, but not limited to all forms of electronic media, print media and all forms of internet and wireless protocol in perpetuity and throughout the universe for advertising, marketing, publicity and promotional purposes in connection with the Sweepstakes and other marketing and promotions related to Sponsor, subjec t to applicable social media platform terms and conditions .  

 

Any entries that the Sponsor deems, in its sole and absolute discretion, to violate the terms and conditions set forth in these Official Rules are subject to disqualification.

 

WINNER SELECTION AND NOTIFICATION:   At approximately 10:00 p.m. PT on October 31, 2024, one (1) potential Prize winner will be randomly selected from all eligible entries received throughout the Sweepstakes Period.  The potential prize winner will be notified by Instagram or X (as applicable) direct message  and/or a comment on your social media post entry by approximately November 10, 2024. Potential winner must respond to the initial notification as directed within seventy-two  ( 72 ) hours of initial notification and will be required to (if an eligible resident of the United States) execute, have notarized and return an affidavit or declaration of eligibility, a liability release, an IRS W-9 Form and, where lawful, a publicity release, or (if an eligible resident of Canada) execute and return the Sponsor’s declaration and release form (which, among other things, acknowledges acceptance of the Prize as awarded, releases the Released Parties from any and all liability in connection with this Sweepstakes, and includes a publicity release), within seventy-two (72) hours from time of initial notification from Sponsor (or shorter time if required by exigencies). Additionally, as a condition of being declared an official winner and receiving any prize, Canadian residents must first correctly answer without assistance of any kind, whether mechanical or otherwise, a mathematical skill testing question via email or other means as determined by Sponsor in their sole discretion.   In the event the winner is a minor, such winner’s parent/legal guardian must also sign any required prize claim documents on behalf of the winner.  If such documents are not returned within the specified time-period, prize notification is returned as undeliverable/social media account by whi ch entry was submitted is no longer active , Sponsor is unable to contact a potential winner, a potential winner (if a resident of Canada) fails to correctly answer the skill testing question within the specified time, or a potential winner is not in compliance with these Official Rules, such prize will be forfeited and, at Sponsor’s discretion, an alternate winner may be selected for the applicable prize. Sponsor and all other Released Parties shall have no liability for any winner notification that is lost, intercepted or not received by the potential winner for any reason. Sponsor, in its sole discretion, will attempt to contact up to three (3) potential winners of the prize in accordance with the above procedure, after which the prize in question may go unawarded if it remains unclaimed. If a potential prize winner is found to be ineligible, or if they have not complied with these Official Rules or declines the prize for any reason prior to award, such potential prize winner will be disqualified and an alternate prize winner may be selected.  If a potential winner is an eligible minor in their jurisdiction of residence, Sponsor reserves the right to award the prize in the name of their parent or legal guardian who will be responsible for fulfilling all requirements imposed on winner set forth herein.   The odds of winning depend on the total number of eligible entries received throughout the Sweepstakes Period.

 

At the sole discretion of the Sponsor and, if requested, the potential Winner may be required to consent to a background check. The background check may include (but is not limited to) an investigation of criminal, arrest, or conviction records, and any other factor deemed relevant by the Sponsor. If requested, such potential Winner must sign forms authorizing the release of personal and background information to the Sponsor. Pending the background check results, the Sponsor, in its sole discretion, reserves the right to limit promotional activities related to the awarding of the Prize.

 

PRIZE:

One (1) Prize (the “ Prize ”) is available consisting of $1,000,000 USD in a method agreed upon between the Sponsor and winner.

IMPORTANT NOTE: In addition to complying with all winner selection, notification and confirmation procedures set out above, in order to be declared as the confirmed winner and receive the Prize, the potential Prize winner must: (a) be available to receive the Prize in person shortly following confirmation as the Prize winner in a United States or Canadian location, as determined by Sponsor and mutually agreeable to the winner and Sponsor); and, (b) will be required to participate in publicity activities related to receipt of the Prize (as agreed upon between Sponsor and winner), unless prohibited by law. Sponsor will provide necessary transportation and accommodation (or reimbursement for preapproved transportation and accommodation expenses), determined at Sponsor’s sole and absolute discretion, that are required for the winner to attend and receive the Prize on the date(s) and at the location determined.   Sponsor reserves the right, at its sole discretion, to modify these requirements.

All federal, state, provincial and local taxes and all other costs associated with prize acceptance and use not specified herein as being provided are the sole responsibility of the winner, as applicable. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Winner may not substitute, assign or transfer prize, unless permitted by Sponsor in its discretion. Released Parties accept no obligation or liability whatsoever in respect of any decision regarding the subsequent distribution, allocation, use or misuse of the Prize.

GENERAL:   Acceptance of the Prize constitutes Prize winner’s (and, in the case of an eligible minor winner, such minor winner’s parent/legal guardian on their behalf) permission for Sponsor and its designees to use Prize winner’s name, Photo, entry, photograph, voice, biographical information, statements and address (city and state/province/territory) and any other likeness for advertising and/or publicity purposes relating to the Sweepstakes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further notice or compensation.  Entrants (and, in the case of an eligible minor entrant, such minor entrant’s parent/legal guardian on their behalf) agree that the Sweepstakes Entities and all other Released Parties to the extent permissible by law: (A) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Sweepstakes or any Sweepstakes-related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of the Prize, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to the Prize, including, without limitation, to such Prize’s quality or fitness for a particular purpose.  However, nothing in these Official Rules shall limit or exclude the Released Parties' liability for death or personal injury causes by its gross negligence  or willful misconduct  or for any other matter where liability may not, as a matter of law, be limited or excluded.

Released Parties are not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, or stolen entries or prize notifications; or for lost, interrupted, inaccessible or unavailable networks, social media platforms, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information.  Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.  No mechanically reproduced, illegible, incomplete, forged, software-generated or other automated multiple entries will be accepted.  Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein. In the event Sponsor is prevented from awarding a prize or continuing with the Sweepstakes as contemplated herein by any event beyond its control, Sponsor shall have the right to modify, suspend, or terminate the Sweepstakes.  If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select a winner in a random drawing from all eligible, non-suspect entries as of the date of the event giving rise to the termination.  Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances.  These Official Rules cannot be modified or amended in any way except in a written document issued by a duly authorized representative of Sponsor.  The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

All entries, Photos, entrants and Sweepstakes-related information submitted are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an entrant’s eligibility to participate in this Sweepstakes; (ii) for the purposes of verifying the eligibility and/or legitimacy of any entry, Photo and/or other information entered (or purportedly entered) for the purposes of this Sweepstakes; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Sweepstakes in accordance with the letter and spirit of these Official Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor.

By entering this Sweepstakes, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted, if applicable, only for the purpose of administering the Sweepstakes and in accordance with the Sponsor’s privacy policy (available at: [ https://feastables.com/policies/privacy-policy ]).This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.

 

GOVERNING LAW: To the fullest extent permitted by law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants or Sponsor in connection with the Sweepstakes shall be governed by and construed in accordance with the internal laws of the State of Illinois, USA without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws.  B y entering, all entrants agree, with respect to any dispute relating to the Sweepstakes, to be subject to the jurisdiction and venue of Cook County, Illinois.

 

 

BY ENTERING THE SWEEPSTAKES, ENTRANT (AND IN THE CASE OF AN ELIGIBLE MINOR WINNER, SUCH MINOR WINNER’S PARENT/LEGAL GUARDIAN ON THEIR BEHALF) AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (C) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT (AND IN THE CASE OF AN ELIGIBLE MINOR WINNER, SUCH MINOR WINNER’S PARENT/LEGAL GUARDIAN ON THEIR BEHALF) HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (D) ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO ENTRANTS .

 

 

WINNER’S NAME: Any legally required winner’s list may be obtained by sending a self-addressed, stamped envelope to: Feastables Halloween $1 Million Sweepstakes Winner, Feastables, Inc., 167 N. Green Street, Floor 4, Chicago, IL 60607. Residents of Canada may omit return postage.  All such requests must be received within six (6) weeks after the end of the Sweepstakes Period.
