Feastables Holiday Giveaway Official Rules

GIVEAWAY DESCRIPTION:  The Feastables Holiday Giveaway (the “Giveaway”) begins on November 25, 2022 at 12:00 a.m. Pacific Time (“PT”) and ends on December 24, 2022 at 11:59 p.m. PT (the “Entry Period”).

Entry in the Giveaway does not constitute entry into any other promotion, contest or Giveaway.  By participating in the Giveaway, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Feastables, Inc., 1189 Wilmette Ave., #225, Wilmette, IL  60091 (“Sponsor”), which shall be final and binding in all respects.

ELIGIBILITY:  Only legal United States residents residing in the fifty (50) United States and the District of Columbia, which, for clarification, specifically excludes Puerto Rico and U.S. territories and possessions, who are thirteen (13) years of age or older are eligible to enter.  Eligible entrants who are less than the age of majority in their state of primary residence (a ‘minor’) must have a parent/legal guardian’s permission to participate in the Giveaway.  Employees, officers and directors of Sponsor, Promo Watch, LLC, MrBeast YouTube LLC, Night Media, and their respective parent companies, affiliates, subsidiaries, advertising, fulfillment and marketing agencies, and influencers (collectively, the “Giveaway Entities”) and the immediate family members, and/or those living in the same household of each, are ineligible to enter the Giveaway or win a prize.  Giveaway is void in Puerto Rico, U.S. territories and possessions and where prohibited by law.

HOW TO ENTER:

There are two (2) ways to enter the Giveaway:

1. WITH PURCHASE:  During the Entry Period, purchase a limited edition “Feastables Holiday Bundle” at feastables.com (“Qualifying Purchase”) while supplies last and automatically receive one (1) entry into the Giveaway random drawing. You will receive one (1) entry for each Feastables Holiday Bundle purchased. Only purchases made at feastables.com will count as an entry, purchases made through any other means will not result in an entry.

1. NO PURCHASE NECESSARY.  To enter without making a purchase, click here and follow the instructions. Each digital entry will receive one (1) entry into the Giveaway. 

Limit five (5) entries per person per day during the Entry Period, regardless of method of entry.  For purposes of these Official Rules, a ‘day’ is defined as any twenty-four (24) hour period during the Entry Period beginning at 12:00 a.m. PT and ending twenty-four (24) hours later at 11:59 p.m. PT.  All entries received from any person that exceed the stated daily limitation will be disqualified.

The Website’s database clock will be the official timekeeper for entries in this Giveaway.  In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible.  The Giveaway Entities shall not be responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Giveaway or by any technical or human error which may occur in the processing of the entries in the Giveaway.  The Giveaway Entities assume no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of entries.  

WINNER SELECTION AND NOTIFICATION:  Within one (1) week from the end of the Entry Period, one (1) potential prize winner will be randomly selected from all eligible entries received during the Entry Period.  The potential prize winner will be notified by telephone and/or e-mail, using contact information provided or collected at the time of entry.  Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason.  If, despite reasonable efforts, a potential winner does not respond within seventy two (72) hours of the first notification attempt, or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner may be selected.  Sponsor, in its sole discretion, will attempt to contact up to three (3) potential winners for the prize in accordance with the above procedure, after which the prize in question may go unawarded if it remains unclaimed.  If any potential prize winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines the prize for any reason prior to award, such potential prize winner will be disqualified and an alternate prize winner may be selected.  The odds of winning depend on the number of eligible entries received throughout the Entry Period.

GRAND PRIZE:

One (1) Grand Prize is available. The Grand Prize consists of:

• One (1) $10,000 cash prize, to be awarded in a form as determined by the Sponsor in its sole discretion (Approximate Retail Value (“ARV”) of $10,000.00);

• One (1) Trip to Greenville, North Carolina, consisting of:
• Round-trip coach air transportation for winner from a major airport, as determined by Sponsor, near the winner’s home within the continental U.S. to Greenville, North Carolina on a TBD date and time. 
• One (1) night, two (2) days hotel accommodations for winner, to be determined by the Sponsor in its sole discretion
• Roundtrip ground transportation for winner to and from hotel and MrBeast’s studio
• ARV of Trip is $2,000.00
• A private tour of MrBeast’s studio and an opportunity to meet MrBeast.
• Exact trip dates to be determined by the Sponsor in its sole discretion. 

In the event a confirmed winner cannot participate in the Prize on the date and time scheduled, Prize will be forfeited in its entirety and, time permitting, awarded to an alternate winner.

GRAND PRIZE FOOTAGE: Sponsor may record and/or take photos of grand prize winner during the private tour of MrBeast’s studio. Grand prize winner (and their parents or legal guardians, if applicable) on the premises may be photographed, videotaped and otherwise recorded by Sponsor (collectively, "Footage"). Footage will be owned by Sponsor who has the right to use, edit, adapt, post, stream, copy and exploit such Footage and all elements embodied therein, including any names and likenesses embodied therein, in any and all media now known or hereafter devised throughout the world, in perpetuity, for advertising, promotional, trade and other purposes. Grand prize winner understands and acknowledges that individuals present at the events may be included in the Footage, in Sponsor’s sole discretion and agree to help Sponsor retain necessary releases (as applicable) if requested by Sponsor to do so.

GRAND PRIZE CONDITIONS: Travel must be taken on dates designated by Sponsor. Exact dates and location to be determined by the Sponsor in its sole discretion, and must be reserved based on Sponsor's sole discretion, or Sponsor will have no further obligation to such winner. Dates of departure and return are subject to change at the sole discretion of Sponsor. Any additional air or ground transportation necessary to redeem prize, or additional fees including service charges, meals, beverages, souvenirs, incidentals, gratuities, phone calls, travel insurance, and any and all other expenses not specifically mentioned herein are the sole responsibility of the winner. Winner will be responsible for and must already own all necessary travel authorizations such as passports, visas, and/or government identification. Winner may also be required to quarantine, provide proof of vaccination, and/or provide proof of a negative COVID-19 test as instructed prior to travel within the timeframe specified by Sponsor or winner may forfeit the Grand Prize at Sponsor’s sole discretion. Other restrictions may apply. Sponsor will attempt to accommodate winner's preferred itinerary, but all specifics thereof will be at Sponsor's discretion. If the winner cannot comply with these restrictions or any other portion of these Official Rules, the prize will be forfeited in its entirety and an alternate winner may be chosen. If the winner resides within a 100-mile radius of destination, ground transportation will be provided in lieu of air transportation and no compensation or substitution will be provided in lieu thereof. Actual value may vary based on point of departure. In the event the winner is an eligible minor, his/her parent or legal guardian will be required to accompany the minor on the trip as a guest. Flight details are subject to availability and airline carrier's regulations and conditions apply. The trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. Exact hotel to be determined by Sponsor, in its sole discretion. Grand Prize winner irrevocably waives all claims against the Released Parties and agrees that the Released Parties will have no liability or responsibility for any claim arising in connection with participation in this Contest, the prizes awarded, personal injury, or wrongful death, a potentially heightened risk of exposure to communicable diseases, viruses, bacteria or illnesses (including, without limitation, COVID-19) and the causes thereof, and sickness arising as a result of the grand prize winner participating in the Contest and related activities, wherever, whenever or however the same may occur.  Grand prize winner fully understands that (a) the novel coronavirus SARS-CoV-2 and any resulting disease (together with any mutation, adaptation or variation thereof, “COVID-19”) is extremely contagious and there is an inherent risk of exposure to COVID-19 in any place where people are or have been present; (b) no precautions, including the protocols that will be implemented from time to time by any/all travel providers or those providing accommodations, can eliminate the risk of exposure to COVID-19; (c) while people of all ages and health conditions have been adversely affected by COVID-19, certain people have been identified by public health authorities as having greater risk based on age and/or underlying medical conditions; and (d) exposure to COVID-19 can result in being subject to quarantine requirements, illness, disability, other short-term and long-term health effects, and/or death, regardless of age or health condition. 

GENERAL PRIZE CONDITIONS: All federal, state and local taxes and all other costs associated with prize acceptance and use not specified herein as being provided are the sole responsibility of the winner. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Winner may not substitute, assign or transfer prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute a prize (or portion thereof) with one of comparable or greater value. All prize details are at Sponsor’s sole discretion. 

GOVERNING LAW:  ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE Giveaway SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF ILLINOIS WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS.
