IMPORTANT: PLEASE CAREFULLY READ AND UNDERSTAND THESE OFFICIAL RULES (“OFFICIAL RULES”). THEY CONTAIN AN ARBITRATION AGREEMENT, JURY AND CLASS ACTION WAIVERS, LIMITATIONS ON FEASTABLES LIABILITY AND OTHER PROVISIONS THAT AFFECT YOUR LEGAL RIGHTS.

 

SWEEPSTAKES DESCRIPTION

 

The Feastables x Target S’mores Sweepstakes (the “Sweepstakes”) begins on June 9, 2025 at 12:00 a.m. Central Time (“CT”) and ends on July 13, 2025 at 11:59 p.m. CT (the “Sweepstakes Period”).

 

The Sweepstakes Period will be broken into five (5) individual weekly entry periods (each, a “Weekly Entry Period”). The Weekly Entry Periods will take place according to the following schedule:

Additionally, after the end of the Sweepstakes Period, one (1) “Sweepstakes Period Prize” (as defined below) winner will be selected from among all eligible entries received throughout the Sweepstakes Period, as described herein.

 

Entry in the Sweepstakes does not constitute entry into any other promotion, contest or sweepstakes. By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with, be legally bound by, and abide to by these Official Rules and the decisions of Feastables, Inc., 167 N Green Street, Chicago, IL 60607 (“Sponsor”, “Feastables”, “we”, “us”), which shall be final and binding in all respects.

 

ELIGIBILITY

 

Only legal United States residents residing in one (1) of the fifty (50) United States or the District of Columbia, Puerto Rico, or U.S. Territories and Possessions, who are eighteen (18) years of age or older at the time of entry are eligible to enter. Employees, officers and directors of Sponsor, MrBeast YouTube LLC, Target Corporation, and their respective parent companies, affiliates, subsidiaries, and the advertising, fulfillment and marketing agencies involved in this Sweepstakes (collectively, the “Sweepstakes Entities”) and the immediate family members (parents, siblings, children, spouses, and life partners of each), and/or those living in the same household of each (whether related or not), are ineligible to enter the Sweepstakes or win a prize. Sweepstakes is void where prohibited by law.

 

HOW TO ENTER

NO PURCHASE NECESSARY.

 

There are two (2) ways to enter the Sweepstakes:

 

  1. Feastables Purchase at Target

    During the Sweepstakes Period, visit a participating Target retail store or the Target mobile App and purchase Feastables product(s). For purposes of these Official Rules, a “Feastables product” shall consist of each individual Feastables product purchased under a single sku. Then, during the Sweepstakes Period using your mobile phone, take a photo of your original purchase receipt or download your receipt from the Target mobile App (screen shots of desktop browsers showing a purchase will not be accepted) that clearly includes the purchase date, store name/location and eligible Feastables product(s) purchased. Scan the QR code on the Feastables product or visit feastables.com/pages/target-smores-sweepstakes (“Sweepstakes Website”) and follow the on-screen instructions to complete the Sweepstakes online entry form, upload your store receipt photo and submit during the Sweepstakes Period. Receipts must be dated for a purchase that took place during the Sweepstakes Period. You will receive one (1) entry into the Weekly Entry Period drawing in which your purchase is confirmed and one (1) entry into the Sweepstakes Period Prize drawing for each individual eligible product purchased and submitted and two (2) entries for each purchase of a Feastables 5ct Milk Chocolate, 5ct Peanut Butter Cups and 28ct Candy Assortment bag, up to a maximum of two (2) entries per day via this method, regardless of whether such products were purchased individually or as part of a single transaction. IMPORTANT NOTE: to be eligible for an entry, receipt photos must be uploaded and submitted by the dates set forth above on the Sweepstakes Website during the Sweepstakes Period.


  2. NO PURCHASE NECESSARY – FREE MAIL IN

    To enter without making a purchase (the “AMOE”), click here: https://easyscanamoe.com/easyscan/default_en/enter?amoe_key=nhfqdn3jfj (the “AMOE Website”) and complete the Entry Request (“Request”) form in its entirety with your complete name, address, city, state, zip code, e-mail address, daytime phone number (including area code), and date of birth and select the day in which you want to enter via the dropdown menu available. Once the Request form is completed, follow the instructions to print out the form and affix the barcode to a post card with first class postage affixed and mail it to the address provided on the AMOE Website. All Requests must be mailed as set forth on the AMOE Website and received by the Mail-In Received By Date corresponding to the Weekly Entry Period for your Request. Limit one (1) barcode per Request. Each mail-in entry will count as two (2) entries into the random drawing corresponding to the Weekly Entry Period selected and two (2) entries into the Sweepstakes Period Prize drawing. Limit one (1) Request per day. Each request must be mailed separately. No copies, facsimiles or mechanical reproductions will be accepted. Sponsor assumes no responsibility for lost, late, incomplete, stolen, misdirected, illegible or postage due entries or mail.

 

Limit of two (2) entries per person, per day of the Sweepstakes Period, regardless of method of entry. In no event can you get more than two (2) entries in a single day. All entries received from any person that exceed two (2) entries will be disqualified. For purposes of these Official Rules, a ‘day’ is defined as any twenty-four (24) hour period during the Sweepstakes Period beginning at 12:00 a.m. CT and ending twenty-four (24) hours later at 11:59 p.m. CT.

 

IMPORTANT NOTE: For entries obtained pursuant to Feastables Purchase at Retail above, please retain your original Feastables product receipt(s), as such receipt(s) may be required to be presented to the Sponsor, at its sole discretion, as part of the verification procedure outlined below.

 

All entries must be received in accordance with the deadlines stated herein in order to participate. The Website’s database clock will be the official timekeeper for online entries in this Sweepstakes. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible. The Sweepstakes Entities shall not be responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of the entries in the Sweepstakes. The Sweepstakes Entities and each of their respective agents, representatives, employees, directors, officers, successors, and assigns (collectively, the “Released Parties”) assume no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of entries.

 

POTENTIAL WINNER SELECTION AND NOTIFICATION

 

On or about each of the drawing dates in the chart above, the corresponding number of potential winners for the corresponding Weekly Entry Period will be randomly selected from all eligible entries received for the corresponding Weekly Entry Period. After the end of the Sweepstakes Period on or about July 21, 2025, one (1) potential Sweepstakes Period Prize winner will be randomly selected from all eligible entries received throughout the Sweepstakes Period. The potential prize winners will be notified by phone and/or e-mail, using contact information provided or collected at the time of entry. Potential winners will be required to execute, and return an affidavit of eligibility, a liability release and, where lawful, a publicity release (which, among other things, acknowledges acceptance of the Prize as awarded, releases the Released Parties from any and all liability in connection with this Sweepstakes, and includes a publicity release), and the potential Sweepstakes Period Prize winner must also complete and return an IRS Form W-9, within seventy-two (72) hours from time of initial notification from Sponsor (or shorter time if required by exigencies and as communicated by the Sponsor). If such documents are not returned within the specified time-period, prize notification is returned as undeliverable, Sponsor is unable to contact a potential winner, or a potential winner is not in compliance with these Official Rules, such prize will be forfeited and, at Sponsor’s discretion, an alternate winner may be selected for the applicable prize. Sponsor and all other Released Parties shall have no liability for any winner notification that is lost, intercepted or not received by the potential winner for any reason. Sponsor, in its sole discretion, will attempt to contact up to three (3) potential winners of each prize in accordance with the above procedure, after which the prize in question may go unawarded if it remains unclaimed. If a potential prize winner is found to be ineligible, or if they have not complied with these Official Rules or decline the prize for any reason prior to award, such potential prize winner will be disqualified and an alternate prize winner may be selected. If a potential winner is an eligible minor in their jurisdiction of residence, Sponsor reserves the right to award the prize in the name of their parent or legal guardian who will be responsible for fulfilling all requirements imposed on winner set forth herein. The odds of winning depend on the number of eligible entries received per Weekly Entry Period for the corresponding Weekly Entry Period. The odds of winning the Sweepstakes Period Prize depend on the total number of eligible entries received throughout the Sweepstakes Period.

 

PRIZES

  • Two Hundred (200) Tier 1 Prizes are available (forty (40) per Weekly Entry Period). Each Tier 1 Prize consists of a S’mores Kit including a City Bonfire Portable Pit, a $50 Target gift card, four (4) Feastables bars, two (2) custom skewers, a branded s’mores kit with six (6) marshmallow and twelve (12) graham crackers, and a Whip-It Stealth Blue Butane Torch. The approximate retail value (“ARV”) of each Tier 1 Prize is $154.60. Gift cards are subject to separate terms and conditions imposed by issuer.
  • Three Hundred (300) Tier 2 Prizes are available (sixty (60) per Weekly Entry Period). Each Tier 2 Prize consists of a S’mores Kit including a City Bonfire Portable Pit, a 5-count pack of Feastables, two (2) custom skewers, a branded s’mores kit with six (6) marshmallow and twelve (12) graham crackers, and a branded matchbook with 60 matchsticks. The ARV of each Tier 2 Prize is $48.76.
  • One (1) “Sweepstakes Period Prize” is available. The Sweepstakes Period Prize consists of a year’s supply of Feastables chocolate (awarded as 365 bars/37 boxes). The ARV of the Sweepstakes Period Prize is $1,110.

 

The total ARV of all Prizes available in this Sweepstakes is $46,658.

 

Limit one (1) Prize per household. No cash alternative or prize substitutions will be allowed, except Sponsor reserves the right to substitute prize(s) of comparable value if a prize listed, or any portion thereof, is unavailable for any reason. All federal, state, and local taxes and all other costs associated with prize acceptance and use not specified herein as being provided are the sole responsibility of each winner.

 

Sponsor makes no warranties, and hereby disclaims any and all warranties, express or implied, concerning any prize furnished by third parties in connection with the Sweepstakes. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, OTHER THAN ANY STANDARD MANUFACTURER’S WARRANTY WHICH COMES STANDARD WITH THE PRIZE, SUCH PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.


GENERAL

 

Except where prohibited, acceptance of a prize constitutes prize winner’s permission for Sponsor and its designees to use prize winner’s name, photograph, voice, biographical information, statements and address (city and state) and any other likeness for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further notice or compensation. Entrants agree that the Released Parties, to the extent permissible by law (A) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Sweepstakes or any Sweepstakes-related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of any prize, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose.

 

Released Parties are not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, or stolen entries or prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No mechanically reproduced, illegible, incomplete, forged, software-generated or other automated multiple entries will be accepted. Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein. In the event Sponsor is prevented from awarding a prize or continuing with the Sweepstakes as contemplated herein by any event beyond its control, Sponsor shall have the right to modify, suspend, or terminate the Sweepstakes. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select winners in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances. These Official Rules cannot be modified or amended in any way except in a written document issued by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

 

All entries, receipts, mail-in entries, and Sweepstakes-related information submitted are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of purchase, identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an entrant’s eligibility to participate in this Sweepstakes; (ii) for the purposes of verifying the eligibility and/or legitimacy of any entry, receipt photo, mail-in entry and/or other information entered (or purportedly entered) for the purposes of this Sweepstakes; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Sweepstakes in accordance with the letter and spirit of these Official Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor.

 

By entering this Sweepstakes, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted only for the purpose of administering the Sweepstakes and in accordance with the Sponsor’s privacy policy (available at: feastables.com/policies/privacy-policy). This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.


GOVERNING LAW

 

To the fullest extent permitted by law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants or Sponsor in connection with the Sweepstakes shall be governed by and construed in accordance with the internal laws of the State of Illinois, USA without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws. Any and all disputes relating to this Sweepstakes shall be brought within the federal, state and local courts within Cook County, Illinois.


MANDATORY INFORMAL DISPUTE RESOLUTION PROCESS

 

If you have a “Dispute” (as defined below) with Sponsor relating to this Sweepstakes, you shall first provide Feastables with written notice (“Notice”) sent to the following address Feastables, 167 N Green Street, Chicago, IL 60607 ATTN: Legal Department. A Notice must include all of the following: (1) a detailed description of the Dispute; (2) the nature and basis of the claim(s); (3) the nature and basis of the specific relief sought and a detailed calculation for that relief; and (4) information sufficient for Feastables to evaluate your claim. Any Notice you submit must be signed by you. You and we agree to negotiate in good faith in an effort to resolve any Dispute. This should lead to resolution, but if for some reason the Dispute is not resolved satisfactorily within sixty (60) days after receipt of a compliant Notice, you and we agree to the further dispute resolution provisions below. Both you and we agree that this informal dispute resolution process is mandatory and a condition precedent that must be satisfied before initiating any formal dispute resolution proceeding. Any applicable statute of limitations will be tolled for sixty (60) days from the time a fully compliant Notice is served on the other party unless the parties mutually agree to extend that period.


BINDING INDIVIDUAL ARBITRATION

 

You agree that the sole and exclusive forum and remedy for any and all disputes, actions, claims, or other controversies between you and Feastables that cannot be resolved informally and that relate in any way to or arise out of the Sweepstakes (“Dispute”) shall be final and binding arbitration. Dispute shall have the broadest possible meaning permitted by law.

 

You and we acknowledge that these Official Rules affect interstate commerce and that the Federal Arbitration Act (“FAA”) and federal arbitration law apply to arbitrations under these Official Rules (despite any other choice of law provision).

 

Arbitration under this Sweepstakes shall be administered by the American Arbitration Association (the “AAA”). The applicable AAA Consumer Arbitration Rules and AAA Mass Arbitration Supplementary Rules shall apply, as modified by these Official Rules. If you initiate arbitration, the applicable AAA rules will govern the payment of fees unless applicable law requires a different allocation of fees in order for this arbitration provision to be enforceable. If you are unable to pay your share of the AAA fees, we will consider a request to pay them on your behalf so long as you have fully complied with the informal dispute resolution process as set forth above.

 

The arbitration will be conducted before a sole neutral arbitrator who shall be located at or near the location where the arbitration will take place. The arbitration will be conducted at a location that is reasonably convenient for you.

 

The award of the arbitrator may require payment of the costs, fees, and/or expenses incurred by the prevailing party consistent with applicable law and the applicable AAA rules. The provisions of Fed. R. Civ. P. 68 may be applied by the arbitrator. The arbitrator shall be bound by these Official Rules as a court would and shall issue a reasoned, detailed decision explaining the essential findings and conclusions on which the award is based.


INDIVIDUAL RELIEF AND CLASS ACTION WAIVER

 

The parties agree that the arbitrator may award the same relief available in court provided that such relief (including declaratory or injunctive relief) shall only be in favor of the individual party seeking relief and only to the extent necessary to provide the relief warranted by that party’s individual claim. YOU AGREE THAT YOU BRING CLAIMS AGAINST FEASTABLES ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, COLLECTIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING. FURTHER, UNLESS WE AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE ANY PERSON’S OR ENTITY’S CLAIMS WITH THOSE OF ANOTHER PERSON OR ENTITY AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CLASS, REPRESENTATIVE, COLLECTIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING. If after exhaustion of all appeals any of these prohibitions on non-individualized relief; class, representative, collective, and private attorney general claims; and consolidation is found to be unenforceable as to a particular claim or with respect to a particular request for relief (such as a request for injunctive relief), then you agree that such a claim or request for relief shall be decided by a court after all other claims and requests for relief are arbitrated.


ADDITIONAL PROCEDURES FOR MASS ARBITRATION FILINGS

 

If twenty-five (25) or more claimants submit Notices or attempt to file demands for arbitration raising similar claims and are represented by the same or coordinated counsel, all of the cases must be resolved in arbitration using the AAA Mass Arbitration Supplementary Rules in stages using staged bellwether proceedings if they are not resolved prior to arbitration as set forth above. The parties agree that the individual resolution of claims in arbitration might be delayed if they elect to pursue claims in connection with twenty-five (25) or more similar claims. In the first stage, the parties shall each select up to fifteen (15) cases per side (thirty (30) cases total) to be filed in arbitration and resolved individually in accordance with this arbitration provision, with each case assigned to a separate arbitrator unless the parties mutually agree otherwise. During this time, no other cases may be filed in arbitration, and AAA shall not accept or administer arbitrations commenced in violation of this provision. If the parties are unable to resolve the remaining cases after the conclusion of the first stage of bellwether proceedings, each side may then select up to another fifteen (15) cases per side (thirty (30) cases total) to be filed in arbitration and addressed individually in accordance with this arbitration provision. During this second stage, no other cases may be filed in arbitration or accepted or administered by the AAA. This process of staged bellwether proceedings (thirty (30) cases total in each set of bellwether proceedings as outlined above) shall continue until the parties are able to resolve all of the claims, either through arbitration or settlement. If these mass filing procedures apply, any statute of limitations applicable to the claims set forth will be tolled from the time the first cases are selected for bellwether proceedings until a given claim is selected for a bellwether proceeding, withdrawn, or otherwise resolved. A court shall have the authority to enforce this provision and, if necessary, to enjoin the filing or prosecution of arbitrations.


OPTING OUT OF ARBITRATION

 

IF YOU DO NOT WISH TO BE BOUND BY THIS ARBITRATION PROVISION, YOU MUST NOTIFY FEASTABLES IN WRITING WITHIN THIRTY (30) DAYS OF THE DATE THAT YOU FIRST HAD NOTICE OF THESE OFFICIAL RULES CONTAINING AN ARBITRATION PROVISION. THIS IS NOT A NEW OPT OUT RIGHT IF YOU WERE PREVIOUSLY BOUND BY AN ARBITRATION PROVISION. YOUR WRITTEN NOTIFICATION TO FEASTABLES MUST BE SENT VIA MAIL TO FEASTABLES, 167 N GREEN STREET, CHICAGO, IL 60607 ATTN: LEGAL DEPARTMENT. IT MUST INCLUDE YOUR NAME AND ADDRESS AS WELL AS A CLEAR STATEMENT THAT YOU DO NOT WISH TO RESOLVE DISPUTES WITH FEASTABLES THROUGH ARBITRATION. YOUR DECISION TO OPT OUT OF THIS ARBITRATION PROVISION WILL HAVE NO ADVERSE EFFECT ON YOUR PARTICIPATION IN THIS SWEEPSTAKES. IF YOU HAVE PREVIOUSLY NOTIFIED FEASTABLES OF YOUR DECISION TO OPT OUT OF ARBITRATION, YOU DO NOT NEED TO DO SO AGAIN. ANY OPT OUT RECEIVED AFTER THE THIRTY (30) DAY TIME PERIOD WILL NOT BE VALID.

 

Notwithstanding any provision in these Official Rules to the contrary, the parties agree that if we make future changes to this arbitration provision, except for changes to the Notice address, you may reject such changes by sending us written notice within thirty (30) days of the change to Feastables, 167 N Green Street, Chicago, IL 60607 ATTN: Legal Department. This is not an opt-out of arbitration altogether. By rejecting any future changes you are agreeing that you will arbitrate any Dispute in accordance with the language of this provision.

 

WE BOTH AGREE THAT, WHETHER ANY CLAIM IS IN ARBITRATION OR IN COURT, YOU AND FEASTABLES BOTH WAIVE ANY RIGHT TO A JURY TRIAL INVOLVING ANY CLAIMS OR DISPUTES BETWEEN US TO THE FULLEST EXTENT PERMITTED BY LAW.
